Carlos Ara regularly advises lenders and investors on distress scenarios involving company restructurings and liquidity injections, defensive postpetition and loan-to-own financing, as well as on going-concern business acquisitions through pre-pack sales and liquidation plans. Recently, he has successfully handled complex multiparty negotiations, sometimes involving pre-litigation and court action. He also regularly advises on the monetization of illiquid assets (e.g., claims, deferred tax assets), liquidity transactions with inventory as collateral and sale-and-leaseback transactions.
